התם הוא דלא רמיא עילויה אבל הכא דרמיא עלויה אפילו טובא. ומינה שמעינן דדוקא עדות שנמסרה לו דרמיא עילויה, אבל עדות שלא נמסרה לו דלא רמיא עילויה לא, ואף על גב דמסהיד בטפי משתין שנין לא מהימן.
