תניא הרי שהלך למדינת הים ושמע שמת בנו ועמד וכתב כל נכסיו לאחר ואח"כ בא בנו מתנתו מתנה. ר"ש בן מנסיא אומר אין מתנתו מתנה שאילו ידע שבנו קיים לא היה כותבן אמר רב נחמן הלכה כר"ש בן מנסיא דאזלינן בתר אומדן דעתא:
