איבעיא להו המקדיש כל נכסיו מהו הפקיר כל נכסיו מהו חלק כל נכסיו לעניים מהו תיקו וכיון דסלקו בתיקו מספקא לן אי שייך הכא אומדנא או לא יראה שאין מבטלין ההקדש וההפקר והחילוק שחילק אין מבטלין מעשיו אלא היכא דבריר לן אומדנא כדפירשתי לעיל:
