אמר ניזיל ניהדר. אמר להו כבר הורה זקן ולא הוי ר' ישמעאל כטועה בשיקול הדעת כיון שלא נחלקו תנאים ואמוראים בדבר זה תחלה. ור' ישמעאל לפי שסברתו לחייב אין כח לר' חייא להוכיח שטעה אלא בסברא נחלק עליו:
