MISHNAH: If one stole a lamb from the flock73And the owners noticed the theft. and returned it74Silently, without notifying the owners. Then the lamb still remains his responsibility., if it died or was stolen he is liable. If the owners were unaware both of the theft and the return, he is no longer liable after they counted the flock and found it complete75Since the owners did not notice the theft, they do not have to be informed of the return..

HALAKHAH: “If one stole a lamb from the flock,” etc. Rebbi Joḥanan said, if the owners knew of the theft, they have to be notified of the return. If they did not know of the theft, they do not have to be notified of the return. Rebbi Simeon ben Laqish said, even if they did not know of the theft, they have to be notified of the return76He reads the first sentence of the Mishnah to apply to all cases, whether the owner knew or did not know. If they did not know, only a count of the flock frees the thief from responsibility.. Rebbi Eleazar said, if it was similar to the case of a ram77In case it is obvious that the theft was returned, even without counting., they do not have to be notified of the return. What means “similar to the case of a ram”? Some say, the shepherd’s staff. Some say, a pandura78Greek πανδοῦρα, a kind of guitar.. Some say, the bell-wether.
