MISHNAH: “I shall be a nazir if I have a son,” when a son is born to him, he is a nazir; if a daughter, a sexless94He has neither penis nor vagina., or a hermaphrodite95He has both penis and vagina. Cf. Mishnah Yebamot 8:6; Notes 224–237; Niddah 1:1, Notes 27,28., he is not a nazir. If he said, “when I see a child of mine,” even if a daughter, a sexless, or a hermaphrodite were born to him he is a nazir.

HALAKHAH: “I shall be a nazir if I have a son,” etc. A daughter counts for nothing, a sexless or a hermaphrodite are questionable96This refers to the first part of the Mishnah. If the vow was conditional, a daughter certainly does not count as a son, but sexless or hermaphrodite might be crypto-males. This creates a problem only for R. Simeon who in the Mishnah holds that a vow of nazir whose validity is in doubt must be kept. There is no problem for the majority who hold that a vow of nazir whose validity is in doubt is void. The Babli, 13a, disagrees and accepts the Mishnah as everybody’s opinion..
